It does not remember the argument, the rain or your intentions. It remembers inputs, movement and impact.
A modern car stopped on a dark, empty European road after a minor collision. No injured people, no theatrical wreckage. Police-blue light grazes the bodywork while the dashboard remains quietly illuminated inside.
Immediately after a crash, every human being becomes a historian.
The driver remembers travelling at roughly the speed limit. The passenger remembers an animal. The witness remembers a noise and, after three questions, a completely different colour of car.
This is not dishonesty. It is the brain performing emergency public relations for itself.
Unfortunately, the modern car has also prepared a statement. It is shorter, colder and contains no adjectives.

A very short memory
The device at the centre of this is the Event Data Recorder, or EDR. “Black box” sounds better on television, although it gives the wrong impression. An EDR is not a microphone under the seat, not a dashcam hidden by Brussels and not a civil servant remotely watching you miss third gear.
Its purpose is much narrower: to preserve critical crash-related parameters shortly before, during and immediately after a qualifying event. Under UN Regulation No. 160, investigators can reconstruct a window beginning five seconds before the event and continuing through the crash.
Most of the time, the relevant values sit in a rolling buffer. If nothing serious happens, yesterday’s enthusiastic roundabout does not become a permanent family archive. A triggering event causes the defined data to be locked according to the system’s rules.

One date, frequently mangled
2022 did not transform every European car overnight.
The EU requirement applied to new passenger-car and light-van types from 6 July 2022. From 7 July 2024, compliant EDRs became necessary for the registration of all new vehicles in the relevant M1 and N1 categories.
Many cars had similar recorders long before either date; others did not expose the same data or require the same retrieval method. So “every car after 2022 has a black box” is the sort of sentence that becomes true only after several useful words have been removed.

Longitudinal and lateral acceleration through the event.
The precise dataset depends on the applicable regulation, vehicle specification, event and system design. EDR data is technical evidence, not a universal export of everything the car has ever known.

These figures are a deliberately simplified illustration, not a real case file. Actual interpretation requires the vehicle-specific report, event timing, measurement tolerances and the rest of the physical evidence.
Three things people call “the black box”
They are not the same witness.
Event Data Recorder
A crash-triggered, standardised record of defined parameters around an event. Specialist retrieval may be needed. This is the actual EDR.
Diagnostic memories
Control units can store faults, freeze-frame values, system interventions and restraint events. The detail, retention and erasability vary enormously by manufacturer and model.
Connected-car data
App services, eCall, fleet tools and insurance telematics may transmit data outside the vehicle under entirely different technical and legal arrangements. Connectivity is not EDR.
What Brussels actually required
Evidence, not a biography
EU law requires the EDR to operate as a closed-loop system. Its data must be anonymised and protected against manipulation and misuse. The recorder may identify the precise vehicle type, variant and fitted safety systems, but it must not retain the VIN digits or other information that would identify the individual vehicle, owner or keeper.
The regulation also says the data can be made available to national authorities, through a standardised interface and on the basis of EU or national law, for accident research and analysis. It does not create a public “download my neighbour’s crash” button, nor does it hand every insurer automatic access to every car.
Who may obtain a particular record in a police investigation, criminal case, civil dispute or insurance claim still depends on national procedure and the facts of the case. The hardware is harmonised more neatly than European law ever is.
A witness can help the defence too
The machine is not automatically the prosecution.
Data can contradict a driver, but it can also support one. It may show that braking began before a witness noticed it, that a safety system intervened, that a belt was fastened or that the recorded speed was lower than somebody’s confident roadside estimate.
Nor is the readout self-explanatory. A speed trace is not proof of who occupied the driver’s seat. A brake switch is not a laboratory measurement of stopping distance. A missing value is not proof that nothing happened. The report must be matched to impact marks, road evidence, vehicle damage, timing and the recorder’s own limitations.
Physics is impressively impartial. People interpreting a file are still people, which is why qualified analysis matters.
A used car under inspection in daylight. The inspector checks intact restraint-system warnings and runs non-invasive diagnostics while the seller stands out of focus. Documentary, calm, no dismantling and no staged broken vehicle.
And then the car is sold
What can a buyer actually learn?
This is where internet folklore becomes commercially useful. A standard pre-purchase diagnostic scan is not the same as a forensic EDR download, and an inspector should not pretend otherwise.
What ordinary diagnostics may reveal, depending on the car, are restraint-system faults, implausible communication histories, freeze-frame data, recurring safety-system errors and other traces that deserve a physical explanation. Some can be cleared. Some are model-specific. None should be interpreted without looking at the body, airbags, belt hardware, glass, dates, panel fit and repair quality.
The useful question is therefore not, “Can you read the black box and prove this car never crashed?” No honest inspection can prove a negative that broadly.
The useful question is whether the seller’s story, the physical car and the electronic traces tell the same story.
The practical side
Cars are poor liars. Sellers vary.
